Terms of Use

Please read these terms before using Proxa.

These Terms of Use (“Terms”) govern your use of the Proxa applications and this website (together, “Proxa”), provided by Nexbit Pty Ltd (“we”, “us”). By installing or using Proxa, you agree to these Terms. If you obtained Proxa through the Apple App Store, Apple’s Licensed Application End User License Agreement also applies, and for App Store builds it governs where it conflicts with these Terms.

License

We grant you a personal, non-exclusive, non-transferable, revocable license to use Proxa on devices you own or control, in accordance with these Terms and any applicable app-store terms.

Purchases and refunds

Proxa is sold two ways, and which one you used decides who handles the money.

Proxa for iOS is bought from the Apple App Store. Apple is the seller, Apple handles billing, and refunds go through Apple — request one at reportaproblem.apple.com, under Apple’s terms. We cannot charge or refund an App Store purchase ourselves.

Proxa for macOS is bought directly from Nexbit Pty Ltd, with payment processed by Stripe. It is a one-time purchase, not a subscription: the license does not expire, and updates are included for as long as we publish them — there is no upgrade fee for a later version.

Nothing in these Terms limits the consumer guarantees you have under the Australian Consumer Law, or under any other consumer protection that applies to you and cannot lawfully be excluded. Where those give you more than this policy does, they apply.

Acceptable use

Proxa is a powerful networking and inspection tool. You agree to use it only lawfully and responsibly. In particular, you agree to:

Third-party services

Proxa can route traffic through proxy servers and subscriptions that you choose. Those services are operated by third parties under their own terms and privacy practices. We do not control them and are not responsible for them.

No warranty

Proxa is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that Proxa will be uninterrupted, error-free, or secure for any particular use.

Limitation of liability

To the maximum extent permitted by law, Nexbit Pty Ltd will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for any loss of data, arising from your use of Proxa. Nothing in these Terms excludes rights you have under mandatory consumer law — including the Australian Consumer Law — that cannot lawfully be excluded.

Changes and termination

We may update Proxa and these Terms from time to time; material changes to these Terms will be posted here with a new date. We may suspend or discontinue Proxa, or your access to it, where reasonably necessary.

Governing law

These Terms are governed by the laws of Australia, without regard to conflict-of-laws principles, and you submit to the non-exclusive jurisdiction of its courts, subject to any mandatory local consumer protections that apply to you.
